Product Warranty

Smarty Rodeo warrants to the original purchaser that no product sold by Smarty Rodeo that bears a Smarty Rodeo brand shall fail under regular use and service due to a defect in material or workmanship within five years from the date of original purchase from Smarty Supply Co. or authorized dealer.   

  

Suppose Smarty Rodeo determines that a product has failed under regular use and service due to a defect in material or workmanship within the warranty period. In that case, we will repair or replace such product at no charge to the original purchaser. Smarty Rodeo shall decide to repair or replace at the discretion of authorized personnel. The repaired or replacement product shall be shipped to the original purchaser unless the original purchaser makes other arrangements for shipment or pick up. However, the original purchaser is responsible for all shipping charges. Repair or replacement does not extend the initial warranty period for a product, and any warranty repair or replacement is warranted only for the balance of the original warranty period. This limited warranty is not transferable or assignable.   

  

The above warranty and repair or replacement obligation does not apply to or include:  

  

  • Any product not sold by Smarty Rodeo or an authorized dealer as new.  
  • Any accessory or other product that does not bear a Smarty Rodeo brand.  
  • Any product that fails other than during regular use and service or that falls outside the warranty period for such product.  
  • Normal wear and tear  
  • Any product that Smarty Rodeo determines (a) was tampered with, disassembled, repaired, modified, or altered without the prior authorization of Smarty Rodeo, (b) damaged during or after shipment, (c) used for a purpose or under conditions that differ from which it is designed (d) not adequately maintained or operated or otherwise misused or (e) subjected to abnormal use or service.  
  • Any party other than the original purchaser to be eligible for warranty repair or replacement, the original purchaser must notify Smarty Rodeo of the product failure within the warranty period for such product and, if requested by Smarty Rodeo, the product must be promptly returned for inspection, freight pre-paid, to Smarty Rodeo at 2059 County Road 3210, Mount Pleasant, TX 75455. The original purchaser must also quickly provide Smarty Rodeo with all such information and photos requested concerning the maintenance, operation, use, and failure of any product claimed to have failed due to a defect in material or workmanship. The original purchaser shall bear all risks of loss or damage during shipment.   

  

THIS LIMITED WARRANTY IS SMARTY RODEO’S SOLE AND EXCLUSIVE WARRANTY AND IS IN PLACE OF ALL OTHER WARRANTIES. UNDER NO   

CIRCUMSTANCES SHALL SMARTY RODEO HAVE ANY LIABILITY FOR ANY CLAIM, LOSS, DAMAGE, INJURY, LIABILITY, OBLIGATION, COST OR EXPENSE THAT DIRECTLY OR INDIRECTLY RELATES TO OR ARISES OUT OF THE USE OR FAILURE OF ANY PRODUCT OR ANY LIABILITY FOR INDIRECT, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF SALES, LOSS OF PROFITS, OR DAMAGE TO REPUTATION OR GOODWILL, WHETHER OR NOT SMARTY RODEO WAS AWARE OF OR ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SMARTY RODEO’S LIABILITY IN CONNECTION WITH ANY INDIVIDUAL PRODUCT SHALL BE LIMITED TO THE ORIGINAL POINT OF PURCHASE.   

  

No Smarty Rodeo authorized dealers or other person is authorized to modify this Limited Warranty or impose any liability or obligation on Smarty Rodeo other than expressly provided herein.
